Agreement to Terms
By creating an account or using Caregiver OS (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
Description of Service
Caregiver OS provides a platform for caregivers to organize medical records, track medications, manage appointments, and coordinate care for children with complex medical needs. The Service is a tool to support caregiving — it does not provide medical advice, diagnoses, or treatment recommendations.
Medical Disclaimer
Caregiver OS is not a medical device and does not provide medical advice. The platform helps you organize and share information; it does not interpret, validate, or advise on that information. Always consult qualified healthcare professionals for medical decisions. In an emergency, call 911.
Account Registration
You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
- Use the Service for any child not in your legal care or for whom you do not have authorization
- Upload content that violates applicable law or the rights of others
- Attempt to gain unauthorized access to other users' data or systems
- Use the Service to provide medical advice to others commercially
- Reverse engineer, decompile, or extract our source code
Subscription and Billing
Paid plans are billed in advance on a monthly or annual basis. Prices are subject to change with 30 days' notice. Refunds for partial billing periods are not provided unless required by applicable law. You may cancel at any time; cancellation takes effect at the end of the current billing period.
Your Data
You retain ownership of all data you upload or create in the Service. You grant us a limited license to store, process, and display that data solely to provide the Service to you. We do not claim any ownership rights over your data. See our Privacy Policy for details on how we handle your data.
Intellectual Property
The Caregiver OS platform, including its design, code, and content created by us, is our intellectual property protected by copyright and other laws. These Terms do not grant you any rights to our trademarks or brand elements.
Service Availability
We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify users of planned downtime. Do not rely on Caregiver OS as your only copy of critical medical information. Maintain offline backups of emergency-critical records.
Limitation of Liability
To the maximum extent permitted by law, Caregiver OS and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including any loss of data. Our total liability to you will not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Caregiver OS from claims, damages, and expenses (including legal fees) arising from your use of the Service in violation of these Terms or applicable law.
Termination
We may suspend or terminate your account for material violation of these Terms, with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ends and your data will be deleted as described in our Privacy Policy.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware.
Changes to Terms
We may update these Terms. We'll notify you of material changes by email at least 30 days before they take effect. Continued use after changes constitutes acceptance.
